Annual Meeting of the Arbitration Court User Group

The Group was established to provide a forum for consultation, discussion and feedback between judges, legal professionals and others involved in arbitration matters in Scottish courts.

The Arbitration Court User Group met on 3 October 2024 at the Judges’ Conference Room, Parliament House, Edinburgh.

The Group was established to provide a forum for consultation, discussion and feedback between judges, legal professionals and others involved in arbitration matters in Scottish courts. Its principal purpose is to provide a forum for consultation, discussion and feedback on arbitration matters, involving judges, legal professionals and others with relevant expertise. Lord Clark has taken over from Lord Glennie as Chair, although Lord Glennie continues to be an active member.

The group reviewed arbitration court business since 2022, and also received an update on the work of the Scottish Arbitration Centre. The Centre has now come of age as a full arbitral institution, and has capability to undertake cases. Some of the opportunities and challenges currently facing arbitration were also considered, including the advantages and disadvantages of remote hearings and the question of costs.

The group also noted that the Arbitration Bill in England may have implications for Scotland. It was agreed that the group will keep developments under review, whilst also being aware of the different economic conditions in Scotland.
