Petitions for Appointment of Executor

Petitions for appointment of an executor to a deceased.  The petitions listed seek appointment of the petitioner as executor to a deceased person.  These are intimated as required by Article 2, Act of Sederunt (Edictal Citations, Commissary Petitions and Petitions of Service) 1971, as read with paragraph 1A of Schedule 4 to the Coronavirus (Scotland) Act 2020.


Company Insolvency

Petitions for the winding up of a company.  These are published as required by Rule 19(2)(a) of the Act of Sederunt (Sheriff Court Company Insolvency Rules) 1986, as read with paragraph 1A of Schedule 4 to the Coronavirus (Scotland) Act 2020.


Fatal Accidents Notice of an Inquiry

Notice of an inquiry into a fatal accident or a sudden death.  Where the Procurator Fiscal has indicated their intention to hold a Fatal Accident Inquiry then details of any preliminary hearing and the date of the inquiry are provided.

 

Simple Procedure Claim and Charges for Payment under Simple Procedure

Simple Procedure actions raised against a respondent whose present whereabouts are unknown.  These claims have been raised under simple procedure.  They are advertised in terms of the Simple Procedure Rules, Part 6 Rule 6.12 (4).  If you are the respondent named, please contact the court detailed to obtain a copy of the Claim Form.     

Formal demand for payment against a party in a Simple Procedure action whose presents whereabouts are unknown.  These are advertised in terms of the Simple Procedure Rules, Part 15 Rule 15.4 (3). 

 

Summary Cause

Summary cause action raised against a defender whose present whereabouts are unknown.  These claims have been raised under the Summary Cause Rules 2002 and are published in terms of Rule 5.5, as read with paragraph 1A of Schedule 4 to the Coronavirus (Scotland) Act 2020.  If you are the defender named, please contact the court detailed to obtain a copy of the summons.  

 

Ordinary Cause

Ordinary cause actions raised against a defender whose present whereabouts are unknown.  In these actions, a Sheriff has granted warrant for citation or service of a document on a person by publication of their details on this website. Publication is made under Rule 5.6. of the Ordinary Cause Rules 1993, as read with paragraph 1A of Schedule 4 to the Coronavirus (Scotland) Act 2020.

 

Simplified Divorce/Dissolution of Civil Partnership

An application for divorce or dissolution of a civil partnership where the present whereabouts of a respondent are unknown.  These applications for simplified divorce/dissolution have been raised under Chapter 33 of the Ordinary Cause Rules 1993.  They are published here as required under Rules 33.77 and 33A.70, as read with paragraph 1A of Schedule 4 to the Coronavirus (Scotland) Act 2020.

 

Summary Application

A summary application warranted against a defender whose present whereabouts are unknown.  In these applications, a Sheriff has granted warrant for citation or service of a document on a person by publication of their details on this website.  Publication is made under Rule 2.13 of the Summary Application, Statutory Applications and Appeals etc. Rules 1999, as read with paragraph 1A of Schedule 4 to the Coronavirus (Scotland) Act 2020.

 

Sheriff Officer Commission

An application to the Sheriff Principal for commission of a Sheriff Officer.  These are published as required by Rule 8 of the Act of Sederunt (Messengers-at-Arms and Sheriff Officers Rules) 1991, as read with paragraph 1A of Schedule 4 to the Coronavirus (Scotland) Act 2020.

 

Charges for Payment

Formal demand against a debtor whose present whereabouts are unknown.  These are published in terms of the Ordinary Cause Rules, Rule 30.9, the Summary Cause Rules, Part 23 Rule 8, Summary Application Rules 1999, Rule 13, or Act of Sederunt (Actions for removing from heritable property) 2012, Rule 3(5)(b), as read with paragraph 1A of Schedule 4 to the Coronavirus (Scotland) Act 2020.

 


Judicial Factors

An application to seek appointment of a judicial factor in the estate of a deceased.  These are published as required by Rules 6 and 23 of the Act of Sederunt (Judicial Factors Rules) 1992, as read with paragraph 1A of Schedule 4 to the Coronavirus (Scotland) Act 2020.

    

Chancery

Applications/Petitions made to the Sheriff of Chancery under sections 26A or 26B of the Titles to Land Consolidation (Scotland) Act 1868 or section 10 of the Conveyancing (Scotland) Act 1874. These are intimated as required by Rule 4 of the Act of Sederunt (Chancery Procedure Rules) 2006, as read with paragraph 1A of Schedule 4 to the Coronavirus (Scotland) Act 2020.
