The Law Society raised the issue of simple procedure actions with us and asked us to clarify the position. Sheriffs Principal have confirmed that in line with the published guidance of 1 June 2020, all simple procedure claims, submitted either via Civil Online, email or paper will be registered provided they were lodged before the receiving court moved into phase 2 of its recovery programme, after 15 June. Any applications for registration lodged during phase 2 will be returned.
From 30 July new simple procedure claims must be submitted via Civil Online unless in exceptional circumstances and on cause shown.
