Sheriff Appeal Court Fees (Civil)

The list below shows some fees that are charged for applications and stages of procedure in the Sheriff Appeal Court (Civil). If you require further information, you should contact the Sheriff Appeal Court.

Fee payable from 1 November 2024:

£61

Guidance: This fee applies to motions and minutes and to oppositions to motions and minutes that are lodged in writing; the fee is payable by the lodging and opposing party.

  • This fee does not apply to oral motions and oral oppositions to minutes.
  • This fee does not apply to written motions which accompany a minute.

Fee payable from 1 November 2024:

  1. under rule 29.13(3)(a) (fix a hearing of the application for a new trial) - £67
  2. under rule 30.2(2) (Transmission of appeal) - £67
  3. under rule 16.4(1) of the Simple Procedure Rules (appeal from simple procedure case) - £67

NOTE: Fee is only payable by the appellant or applicant in an appeal, and only by the respondent in a cross-appeal.

Guidance: For clarity “cross-appeals” do fall to be charged under this heading. The fee is payable by the lodging party.

Fee payable from 1 November 2024:

  • under rule 16.4(1)of the Simple Procedure Rules - £283

Guidance: This fee is only to be charged for substantive hearings; i.e. those where a fixing fee was due to be paid as specified above. The fee is payable by the appellant.

  • Per 30 minutes or part thereof - £15
  • in addition, correspondence fee where applicable - £15
