From 1 April the
Scottish Land Court became one of ”the Scottish courts” as defined by the Judiciary and Courts (Scotland) Act 2008 and within the responsibility of the Lord President.
The change is made by
Judiciary and Courts (Scotland) Act 2008 (Scottish Land Court) Order 2017, which also specifies that the members and Deputy Chairman of the Scottish Land Court will become judicial office holders as defined by the 2008 Act. Staff will transfer from Scottish Government into the Scottish Courts and Tribunals Service.
The Scottish Land Court will retain its identity as a separate court but its administration will be under the auspices of the Supreme Courts. The current Chairman is Lord Minginish.
The Land Court was created by the Small Landholders (Scotland) Act 1911 and opened its doors for business in 1912.It celebrated its centenary in 2012 when a volume of essays on aspects of the history of the Court was published under the title No Ordinary Court, a name intended to reflect the Court’s unique character as a peripatetic specialist court, which comprises both legally qualified and agriculturally qualified members.The offices of the Land Court will remain in George Street, Edinburgh and contact details are:
